TERMS AND CONDITIONS

INTRODUCTION

The services provided by Golden Prestige (hereinafter referred to as the "Service Provider") are carried out in accordance with the following provisions ("the General Terms and Conditions"). By using the services provided by the Service Provider, the customer (the "Customer") acknowledges to have read the General Terms and Conditions and declares to accept them completely. After reading the General Terms and Conditions and if you have any questions, please contact the Service Provider's customer service at contact@gpgrading.com.

 

. PURPOSE

This website allows the certification of collector cards at the request of the Customer. The certification of cards means in this case that the Service Provider performs two services:

  1. the cards are graded according to their quality/condition, according to a strict scale and very precise criteria (see Article "Grading Scale");

  2. the cards are then sealed in a specially designed protection.

 

 

. CUSTOMER ACCEPTANCE

The Customer's acceptance is materialised by his electronic signature, confirmed by the "Click on Payment of the Offer", as well as by the transmission of his bank details at the end of the payment of his order. This electronic signature has the value of a handwritten signature between the parties. This double step is equivalent to the Customer entering into the contract and acknowledging that he has fully read and approved the complete General Terms and Conditions.

 

. DUTIES AND OBLIGATIONS OF THE CUSTOMER

The Service Provider's offer is intended for Internet users of legal age with capacity or emancipated minors. Any non-emancipated underage person or adult with incapacity must ask to be assisted by a legally competent person. The Customer declares and guarantees:

  1. that all registration information is correct;

  2. that all mandatory fields contain true, exact, complete and up-to-date information;

  3. that none of the collector cards he wants to have certified is a counterfeit;

  4. that none of the collector cards he wants to have certified has been explicitly and intentionally altered in order to hide certain defects and thus mislead the Service Provider in his qualitative assessment of the condition of the card (e.g. use of ink) or to prevent him from tracking the origin of the card and the extension from which it originates;

  5. that he is the owner of the collector cards that he entrusts to the Service Provider;

  6. that none of the collector cards he wants to have certified shows signs of deterioration or degradation in an advanced stage (e.g. mould, complete or partial tearing, significant material deposits, addition of adhesive tape);

  7. that the cards will be sent protected;

  8. that he accepts the Golden Prestige grading scale;

  9. that he shall not dispute the grade obtained if he is not satisfied with it.

 

. PRICE REDUCTIONS

Price reductions granted by the Service Provider may be reviewed at any time

 

. RATES-STOCKS

The offers are valid within the limits of available stocks and subject to the proper functioning of the tools necessary for the marking and sealing of the protections.

The prices of the services provided by the Service Provider are indicated on the Service Provider's website. They are stated in Euros including all taxes. These prices may change at any time: the changes then only concern future orders. Orders in progress are not affected by these changes.

The amounts of the fees for the preparation/logistics/transportation of the Golden Prestige protections sold are indicated on the summary page of the Customer's order, before final validation of the intended purchase.

 

. ORDER

When ordering, the Customer must follow the following process:

  1. select the number of cards to be certified on our website ;

  2. validate the contents of the basket and the choice of delivery method;

  3. register the requested contact details;

  4. pay online by CB, Visa or Mastercard;

  5. validate the payment.

     

The Customer will receive an order confirmation e-mail.

The Service Provider reserves the right to cancel or refuse any order from a Customer with whom there is a dispute over the payment of a previous order or whose file has a contentious history.

Any order implies acceptance of the prices and descriptions of the items available for sale.

 

 

 

. TERMS OF PAYMENT

 

. Securing payment

Payment is made via a secure platform operated by Stripe. The data recorded by the Stripe payment system constitutes proof of the financial transactions carried out by bank card. No data is stored by the Service Provider.

The Customer may also pay for his purchases on the Website by Paypal. The data recorded by Paypal constitute proof of the financial transactions carried out by this method of payment. Paypal does not transmit confidential information relating to the payment to the Service Provider.

 

. Terms and conditions

The payment of the services takes place once the summary of the order is validated. Payment is made exclusively by Paypal, CB, Visa or Mastercard by filling in the information requested on the relevant page of the Service Provider's website. The order will only be shipped once the Customer's bank details have been verified and the bank card debit authorisation has been received. If such authorisation is not received, the service will not be provided.

 

. Acknowledgement of receipt of order

Once payment has been made, the Customer will receive an order summary e-mail that sets out the contract between the parties.

 

. TRANSPORT

The cards are shipped in two ways:

  1. when the Customer sends them to the Service Provider;

  2. when the Service Provider sends them back to the Customer.

The shipping costs are borne by the Customer.

 

. CANCELLATION

In the event of cancellation after the cards have been sent, the cost of shipping the cards back will be charged to the Customer.

Once the cards have been graded, it is impossible to cancel the order.

 

. Shipment by the Customer

The Customer bears the cost of sending the cards to the Service Provider and is responsible for the risk of loss during shipment.

In case of non-receipt of the Customer's package within 30 days of payment, the transaction may be cancelled by the Service Provider. In this case, the Customer will be refunded the full amount of the transaction.

If the cards are received after this period and the sale has been cancelled, the Service Provider will return the cards within 7 working days from the receipt of the shipping costs due by the Customer for this return.

In order to avoid any dispute, it is strongly advised to send the package with a tracking number and a guarantee.

The Customer must ensure that the cards are properly protected so that they arrive in the same condition as when they were sent. It is advisable to send them in a flexible pouch and a "toploader".

The Customer will be returned the protections he provided at the same time as the graded cards whenever possible, without any obligation from the Service Provider.

 

. Return by the Service Provider

Once the cards have been sealed, they are returned to the Customer and a tracking number is provided. The Customer's address is indicated in the order form. It may differ from the payer's address.

In the event that the Customer is absent at the time of delivery, it is his responsibility to collect the delivery from the address indicated by the post office or the carrier and in accordance with the terms and conditions specified by the carrier on the delivery notice left at the delivery address. If the Customer fails to collect the delivery within the time limit specified on the notice, the corresponding package shall be returned to the Service Provider. If the Customer wishes the Service Provider to make a second delivery attempt, he shall pay the return costs of the first delivery as well as the shipping costs of the second delivery attempt.

Deliveries that are refused or sent to an incorrect address will be redelivered subject to the payment of new shipping costs. Delivery times vary according to the offer selected. This period starts as soon as the Service Provider has received the cards to be certified.

If the cards sent by the Customer do not comply with the order form, this period shall be suspended until a new agreement has been reached.

Delivery times are subject to the services provided by external service providers that the Service Provider does not control: the Customer accepts that delivery times are only indicative and may change, even though he may have already placed an order.

The delivery costs will be displayed on the Service Provider's website. They vary according to the number of cards to be certified.

Delivery shall be made at least in the European Union, to the address indicated under the Customer's responsibility.Orders to be delivered to other countries may, if necessary, be accepted by the Service Provider on a case-by-case basis. Delivery will not be ensured in case of force majeure and/or transport strike.

In the event of loss of the delivery package, the Service Provider shall reimburse the costs incurred and shall compensate the Customer up to the amount of the insurance taken out.

 

. NON-CONFORMITY

If the cards to be certified sent by the Customer are different from those mentioned in the order form, the Service Provider reserves the right to terminate his service. The Customer will be refunded, minus the shipping costs incurred for the return of the cards.

The Service Provider may also modify the Customer's order to make it compliant with the cards received. An additional charge or a reduction in price may be requested. The processing time of the order may then be extended.

Cards whose dimensions do not allow them to be placed in the Service Provider's box cannot be packaged and will be returned to the Customer.

 

. GRADING SCALE

The Customer using the Service Provider's services accepts the grading scale (the "Grading Scale") developed by the latter. In case of disagreement with the grading, the Customer shall not hold the Service Provider liable or claim a lack of compliance.

The Service Provider may refuse to grade and certify a card whose condition is deteriorated.

 

. HANDLING AND PHOTOGRAPHY

The cards provided by the Customer are handled with care by the Service Provider. However, if the card is damaged or lost within the Service Provider's premises, he shall reimburse and compensate the Customer. During the normal course of its grading and certification operations, the Service Provider may take or have taken one or more digital photographs or other types of photographs, images or reproductions of each card to be certified. In consideration of the services provided by the Service Provider, the Customer, on his own behalf and on behalf of any third party for which he may act, hereby allows the Service Provider to take or have taken one or more photographs of each certified card. The Customer further acknowledges that the Service Provider is the owner of such photographs and that the Service Provider may use and exploit them for commercial purposes and for other purposes at the discretion of the Service Provider, including, but not limited to, the publication and re-publication or reproduction, in any medium, of such photographs.

 

. LIABILITY OF THE SERVICE PROVIDER - WARRANTY

In accordance with the legal provisions, the Service Provider guarantees the Customer against any lack of conformity of the services and any hidden defect, resulting from a design or manufacturing defect in the services provided and making them unsuitable for the use for which they were intended, to the exclusion of any negligence or fault on the part of the Customer, for a period of 7 (seven) days as from the date of their delivery to the Customer, unless otherwise provided by law.

In order to assert its rights, the Customer shall, under penalty of forfeiture of any action relating thereto, inform the Service Provider, in writing, of the existence of the defects within a maximum of 24 (twenty-four) hours from the date of their discovery.

The Service Provider shall rectify or arrange to rectify, at its sole expense, the services found to be defective.

In any event, the Service Provider's warranty is limited to the amount (excluding VAT) paid by the Customer for the provision of the services.

 

. DAMAGING

The Service Provider is not responsible for damage to the Golden Prestige protections after they have been sent.

The Service Provider is not responsible for damage to the sealed cards in the event that the Golden Prestige protections are broken or damaged.

 

. NON AFFILIATION

The Golden Prestige Service Provider is independent of all companies and licenses of playing and collectible cards. Golden Prestige is in no way affiliated with any TCG trademark.

 

. LACK OF CONFORMITY

Upon receipt of the order, the Customer must check the conformity of the protections received in execution of his order.

. Non-conforming delivery

The Service Provider shall endeavour to deliver to the Customer conforming protections, in accordance with the provisions of L 211-4 and L 211-5 of the French Consumer Code. However, the Service Provider cannot prevent a possible non-conforming delivery.

In case of major non-conformity, the Customer must notify the Service Provider and return the non-conforming protections (damaged item, damaged package, ...) to the Service Provider's Customer Service, within 24 hours of their receipt according to the terms and conditions set forth in Article 17.2 "Terms and Conditions of Returns".

The Service Provider shall make its best efforts to deliver the compliant product to the Customer within the estimated time limit indicated at the time of order validation.

After this 24-hour period, claims for non-conforming delivery shall no longer be admissible and the Service Provider shall not be obliged to make a new delivery.

In case of abnormal or abusive returns, the Service Provider shall refuse to process any further orders.

The Customer declares and accepts that the grading cannot be a source of a lack of conformity.

 

. APPLICABLE LAW - DISPUTES

This contract is subject to the laws of the United Arab Emirates.

The language of this contract is English.

In the event of a dispute, the courts of the United Arab Emirates shall have exclusive jurisdiction.

 

. Terms and Conditions of Returns

In the event of a non-conforming item, the protections must be returned:

  • in their original packaging, in perfect condition ;

  • accompanied by the proof of order;

  • without the article having been used or opened;

  • to the Service Provider's postal address;

  • accompanied by a return form (provided by the Customer Service).

 

. CUSTOMER SERVICE

For any question or information concerning the use of the Website or the provisions of the General Terms and Conditions, or the protections appearing on the Website, the Customer can contact the Service Provider via:

. PRIVACY POLICY

The Service Provider undertakes not to disclose to third parties the information provided by the Customer except to its business partners if the Customer has agreed so when providing the contact details. The communicated information will also be used by the internal services of the Service Provider, for the treatment of the orders and to reinforce and provide customised communication and the product offer intended to the members and customers of Golden Prestige, in particular by the newsletters within the framework of the customisation of the website.

The Service Provider's website is also designed to be particularly attentive to the needs of the customers. It is for that reason that it makes use of "cookies". The purpose of a cookie is to indicate that you have visited the website. The cookies are thus used by Golden Prestige only in order to improve the personalised service intended for the Customer.

 

. GENERAL CONDITIONS OF USE OF THE WEBSITE

The consultation of the Service Provider's website implies the acceptance of the following conditions.

These provisions apply only to the Service Provider's Website (the "Website"), which may contain links to other third party websites that the Service Provider does not control. The privacy policy in this document does not apply to such third party websites.

The user of the Website (the "User") acknowledges and accepts that the contents appearing on the Website may be subject to legal protection, by copyright, database law, trademark law, patent law or any other legal protection (in particular via civil liability law).

The User of the Website must not copy, reproduce, distribute, publish, modify, adapt, transfer or assign in any form whatsoever the contents without the express authorisation of the holder of the rights. Otherwise, civil, administrative or penal sanctions may be applied.

The Service Provider disclaims any liability for the technical consequences of connecting to his Website, in particular in the event of connection difficulties due to technical or material defects, or any problem related to network congestion.

The Service Provider shall not be liable for any material or immaterial damage caused to the User of the Website or to third parties (in particular to computer equipment and data stored therein) as a result of the use of the Website, as well as for the consequences that may arise from the personal, professional or commercial activities of the Users of the Website.
